Ranchi: Adivasi Buddhijivi Manch national convenor Victor Malto said that the Jharkhand Cabinet has once again passed the same Panchayat Raj system, replacing the rules of the Parliamentary Act of 1996.
“It is noteworthy that the Honorable Jharkhand High Court, in its mandamus issued in petition number WP(PIL) No. 1589/2021 filed by the Tribal Buddhijivi Manch stated in “Paragraph 12″ that the Panchayat Raj Act of 2001 cannot be considered consistent with the Parliamentary Act of 1996. Therefore, the Jharkhand government was required to frame rules in accordance with the Parent Act of 1996, but the state government has wrongly passed the provisions of the three-tier Panchayat Raj system of the Jharkhand Panchayat Raj Act of 2001, which was passed by the Legislative Assembly, disregarding the Parliamentary Act of 1996 meant for scheduled areas,” he said.
“In other words, the current rules are contrary to Sections 3 and 4(m) of the Parliamentary Act of 1996, which grant a total of seven powers to the Panchayat and Gram Sabha at the appropriate level, subject to exceptions and modifications. This will be challenged in the judiciary after the gazette notification is published,” he added.
